By accessing the Site or using our Services, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

2. Our Services

We provide premium dog training services, including in-home training, group classes, board-in programs, aggression rehabilitation, obedience training, and related consultations in the Lakeland, Florida area and surrounding communities. A key part of our Services includes text messaging (SMS/MMS) for appointment reminders, training updates, progress reports, marketing promotions, customer support, and other communications.

3. Text Messaging (SMS/MMS) Terms

By providing your mobile phone number and opting in (e.g., by texting a keyword, checking a box, or submitting a form), you consent to receive text messages from us.

• Program Description: Messages may include transactional updates (appointment confirmations, training session reminders, progress reports), marketing offers, promotions, surveys, and customer service responses.

• Message Frequency: Message frequency varies but will generally be 4–10 messages per month or as needed for your training program.

• Opt-Out: You can stop receiving messages at any time. Reply STOP to any message or contact us at info@amisfitstail.com or (863) 838-4188. We will send a confirmation and honor your request promptly.

• Help: Reply HELP for assistance or contact us at the details above.

• Costs: Message and data rates may apply. Check with your carrier for details.

• Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.

• Consent: You represent that you are the account holder or have permission from the account holder to provide the number. We will obtain prior express written consent where required by law (TCPA compliance).

4. User Accounts and Registration

To access certain features (such as booking evaluations or client portals), you may need to create an account. You agree to provide accurate, current information and keep it updated. You are responsible for maintaining the confidentiality of your account and password.

5. User Conduct and Prohibited Activities

You agree not to:

• Use the Site or Services for any illegal purpose or in violation of applicable laws (including TCPA, CAN-SPAM, or Florida consumer protection laws).

• Transmit harmful code, spam, or unsolicited messages.

• Infringe on our or others’ intellectual property rights.

• Harass, abuse, or harm others (including our trainers or staff).

• Attempt to gain unauthorized access to any part of the Services.

• Engage in any activity that disrupts or interferes with the Site.

We reserve the right to terminate or suspend your access for violations.

6. Intellectual Property

All content on the Site (text, graphics, logos, images, training materials, videos, etc.) is owned by or licensed to A Misfits Tail LLC and protected by U.S. copyright, trademark, and other laws. You may not copy, modify, distribute, or commercially exploit our content without prior written permission.

7. Privacy

8. Payments and Bookings

All payments for training programs, evaluations, board-in services, and products are processed through our Site or approved third-party processors. Some programs may involve recurring payments or deposits. Refunds and cancellations are subject to our separate cancellation policy (available during booking). By booking, you agree to our pricing and terms in effect at the time of purchase.

9. Disclaimers

The Site and Services are provided “as is” and “as available” without warranties of any kind. Dog training results vary by individual dog, owner participation, and consistency. We do not guarantee specific behavioral outcomes. We disclaim all warranties to the maximum extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law, A Misfits Tail LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or Services, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including attorney fees) arising from your violation of these Terms, your use of the Services, your dog’s behavior, or your infringement of any rights.

12. Termination

We may terminate or suspend your access to the Services at any time, with or without cause or notice. Upon termination, your right to use the Services ceases immediately.

13. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts located in Polk County, Florida.

You agree to resolve disputes on an individual basis (no class actions).

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on the Site and updating the “Last Updated” date. Your continued use constitutes acceptance of the revised Terms.
